Who are we?

Chilangos Mexican Cantina and its associates are a group of restaurants based in various locations around Australia. We are part of a group of restaurants that offer the flavours of Mexican cuisine in a casual dining atmosphere.

Chilangos Mexican Cantina is committed to protecting your privacy. Its associated entities (Us, Our, We or the Company) understand the importance of the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (Privacy Act) and the Privacy Amendment (Enhancing Privacy Protection) Act 2012. Ensuring that your personal information is handled in a safe and responsible way. Chilangos Mexican Cantina may amend or update this Privacy Policy from time to time, with or without notice to Users.   • Send you service emails (booking confirmation and post-dining feedback).

We may analyse your personal information to create a profile of your interests and preferences so that we can contact you with information relevant to you. We may make use of additional information about you when it is available from external sources to help us do this effectively.

Who has access to your information?

We will not sell, distribute, or lease your personal information to third parties. Any personal information we request from you will be safeguarded under current legislation. We will only share your information with companies if necessary to deliver services on our behalf.  For example service providers (e.g. Uber Eats, Deliveroo, Menulog for the provision of online bookings), third-party payment processors, and other third parties to provide our Sites and fulfil your requests, and as otherwise consented to by you or as permitted by applicable law. 
Third parties whose content appears on our Site may use third-party Cookies, as detailed below. Please note that we do not control the activities of such third parties, nor the data they collect and use and advise you to check the privacy policies of any such third parties.

How and where do we store data?

We hold personal data in a number of ways, including electronically, in hard copy form, in electronic databases and files, both at Our own premises and with the assistance of our service providers including at archive facilities and external data management facilities. We implement a range of measures to protect the security of that personal data. The steps We take to secure personal information include website protection measures, security restrictions on access to Our premises and computer systems together with Our service provider’s facilities. The Personal data we hold will be held securely in accordance with Our internal policy and the law. We take steps to protect the Personal data We hold against loss, unauthorised access, use, modification or disclosure, and against other misuse. We also take measures in respect of destroying or de-identifying personal data that is no longer needed for any lawful purpose.
We cannot guarantee, in every circumstance, the security of the Personal Information you provide on the website or via any electronic form of communication with us.
Where data is held overseas or by third parties, We require third parties to store such data in restricted access premises and provide appropriate protection against unauthorised disclosure. As a minimum security requirement, password authentication is required to access those databases in all cases.
Chilangos Mexican Cantina may hold Users personal data both before and after the cancellation of each User’s account, but only for as long as Chilangos Mexican Cantina is lawfully entitled to do so.

Restaurant groups

We may share your information (such as meal or seating preferences and special occasions) with other restaurants in the same restaurant group. This is to enhance the hospitality experience that we (the restaurant group) provide you when you dine with us (such as, trying to seat you by a window, if you previously expressed a preference for window seating) (“customised service”) and to improve our table and shift planning.
In addition to providing you with more customised service, we may, as permitted by applicable law, share your information with our restaurant affiliates to support operations, such as to perform analytics, tailor marketing to you, support a loyalty program that you have chosen to participate in, and improve services.

Terms and Conditions

Chilangos Mexican Cantina may amend, update and change these Terms and Conditions from time to time, with or without notice.
By accessing the Website and/or using the Services, all Users consent to the collection, use, disclosure, storage and processing of their information in accordance with this Privacy Policy.
You affirm that you are either more than 18 years of age, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions of Use, and to abide by and comply with these Terms and Conditions of Use. We can terminate or suspend your account or access to Websites and Services at our discretion, including but not limited to, if we see signs of fraud, abuse or suspicious activity, or any breach of these Terms and Conditions. What happens if our business changes hands?

We may, from time to time, expand or reduce our business and this may involve the sale and/or the transfer of control of all or part of our business. Any personal data that you have provided will, where it is relevant to any part of our business that is being transferred, be transferred along with that part. The new owner or newly controlling party will, under the terms of this Privacy Policy, be permitted to use that data only for the same purposes for which it was originally collected by us.

Indemnity

You agree to defend, indemnify and hold harmless Chilangos Mexican Cantina and related corporations, affiliates, and the officers, directors, employees and agents of these entities, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees) arising from or in connection with (i) your use of and access to the website (including any online ordering and applications) (ii) your violation of any term of these Terms and Conditions of Use and (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right (iv) any claim that one of your User Submissions caused damage to a third party and (v) use of the User Submissions by Chilangos Mexican Cantina. To the extent permitted by law, we have no liability for any loss or claim that you may suffer or incur as a result of your use of the Service.
